General Terms. Lidl Gift Cards (as defined below) are issued by LUS Gift Card, LLC, a Virginia limited liability company (the “Issuer”), who is the sole obligor to Lidl Gift Card owners. Issuer, collectively with Lidl US, LLC, a Delaware limited liability company, shall be referred to herein as “we,” “us” or “Lidl.” These Lidl US Gift Card Terms and Conditions (“Terms and Conditions”) are applicable in addition to the Website Terms of Use and Privacy Policy applicable to the lidl.com website.

BY CLICKING THE “ACCEPT” BUTTON OR USING THE LIDL GIFT CARD, YOU: (i) REPRESENT THAT YOU ARE DULY AUTHORIZED TO ACCESS AND USE THE LIDL GIFT CARD; AND (ii) ACCEPT THESE TERMS AND CONDITIONS, AND AGREE THAT YOU ARE LEGALLY BOUND BY THEM.

LIDL RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CHANGE, MODIFY, UPDATE, ADD OR REMOVE ANY OF THE TERMS CONTAINED IN THESE TERMS AND CONDITIONS, IN WHOLE OR IN PART, AT ANY TIME. AMENDMENTS TO THESE TERMS AND CONDITIONS WILL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE NEW TERMS AND CONDITIONS ON LIDL’S WEBSITE AT WWW.LIDL.COM, AND BY USING THE LIDL GIFT CARD FOLLOWING THE POSTING OF SUCH NEW TERMS AND CONDITIONS, YOU ARE AGREEING TO COMPLY WITH AND BE BOUND BY THE NEW TERMS AND CONDITIONS.

Redemption. Each Lidl Gift Card is usable up to the balance only to buy goods at any Lidl® store in the United States. Lidl Gift Cards cannot be used to purchase other gift cards, prepaid cards or Lottery tickets and are not redeemable for cash except as required by law.

Nonreturnable; Not for Resale. Notwithstanding anything contained in these Terms and Conditions, Lidl plastic gift cards and eGift cards (collectively, the “Lidl Gift Card(s)”) are not returnable or refundable for cash except in states where required by law. Resale of Lidl Gift Cards is strictly prohibited.

Liability. The balance on any Lidl Gift Card is solely the liability of the Issuer.

Not for Promotional Use. Lidl Gift Cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities (including without limitation via web sites, Internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless you obtain Issuer’s prior written approval, which may be withheld at Issuer’s sole discretion. Such approval shall be conditioned on, among other things, execution of and compliance with Issuer’s gift card license agreement. From time to time, Issuer may issue or award “rewards”, “promotional gift cards”, “credits”, “vouchers”, or similar physical or electronic gift cards (collectively, “Promotional Cards”). Generally, these Promotional Cards have the same terms and conditions as the Lidl Gift Cards described here, however, they may have expiration dates, delayed activation dates or may be subject to additional restrictions or exemptions as provided on the Promotional Cards themselves, any packaging or other written materials that accompany such Promotional Cards, or any applicable law.

No Affiliation with Lidl. Use of Lidl’s name, logo, trade dress (including any image/likeness of the Lidl Gift Cards) or trademarks (or those of any of Lidl’s parents, subsidiaries or affiliates) in connection with the purchase or use of Lidl Gift Cards is strictly prohibited. Furthermore, the use of Lidl Gift Cards in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or otherwise affiliated with, Lidl or any of its parents, subsidiaries or affiliates is prohibited.

Compliance with Laws. By purchasing Lidl Gift Cards, you are certifying and representing to Lidl that the activities in connection with which the Lidl Gift Cards will be used will comply with these Terms and Conditions and all applicable laws, rules and regulations, and that the Lidl Gift Cards will not be used in any manner that is misleading, deceptive, unfair or otherwise harmful to consumers or Lidl. In addition, you agree to defend and indemnify Lidl and its parents, subsidiaries and affiliates, and each of their respective directors, managers and/or officers, from and against any claims, expenses or liabilities made against or incurred by any of them in connection with your use of the Lidl Gift Cards or violation of any of these Terms and Conditions, the Website Terms of Use and Privacy Policy. You agree to release Lidl and its parents, subsidiaries and affiliates, and their respective directors, managers and/or officers from and against any and all claims, expenses or liabilities you have or may have against or incurred in connection with your use of the Lidl Gift Cards or violation of any of these Terms and Conditions, the Website Terms of Use and Privacy Policy.

Lost or Stolen Gift Card. Lost or stolen cards will not be replaced. The risk of loss and title for Lidl Gift Cards pass to the purchaser upon the sale. Neither Lidl nor any of its parents, affiliates or subsidiaries shall have liability to you for lost or stolen Lidl Gift Cards. Notwithstanding the foregoing, defective cards may be replaced by Lidl upon proof of purchase. Replacement cards will be issued pre-loaded with a balance equal to the balance of the defective card at the time of return.

Balance. To check your balance, go to any store, or call 1-844-747-5435. The balance you are provided is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the updated balance is delayed.

Expiration. Lidl Gift Cards issued by LUS Gift Card, LLC for sale at Lidl US Stores never expire. Promotional Cards issued by LUS Gift Card, LLC may have an expiration date.

No fees. Lidl Gift Cards have no fees associated with them.

Returns. All returns for purchases made using a Lidl Gift Card will result in credit to a Lidl Gift Card or issuance of a new Lidl Gift Card in the amount of the return.

Governing Law and Disputes. When you purchase, receive, or redeem a Lidl Gift Card, you agree that the laws of the Commonwealth of Virginia shall govern these Terms and Conditions, without regard to principles of conflict of laws. Any action relating in any way to Lidl Gift Cards shall be adjudicated in any state or federal court in Arlington County, Virginia, and you consent to exclusive jurisdiction and venue in such courts.

WHERE PERMITTED UNDER APPLICABLE LAW, YOU AGREE THAT YOU MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR A CLASS MEMBER IN ANY PURPORTED CLASS OF REPRESENTATIVE ACTION.

YOU WAIVE ANY TRIAL BY JURY AND AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE GIFT CARD OR THESE TERMS AND CONDITIONS MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE THE CAUSE OF ACTION IS PERMANENTLY BARRED.

Third-Party Gift Card Terms and Conditions. These Terms and Conditions apply exclusively to Lidl Gift Cards issued by LUS Gift Card, LLC. Lidl may from time to time sell gift cards issued by a third party. When you buy a third-party issued gift card, you agree to the terms and conditions of the card issued by said third party.

Fraud. Issuer has the right to close Lidl Gift Card accounts and may request alternative forms of payment if Issuer believes such cards have been fraudulently obtained. In general, and in the interest of protecting you from fraud, we recommend that you do not purchase discounted cards from third party resellers, including, but not limited to, those on Craigslist, eBay, Raise.com or similar sites. There are NO authorized resellers of Lidl Gift Cards. Often these cards are purchased with stolen credit cards and may be closed at any time. Limitation of Liability. ISSUER, ITS PARENTS, SUBSIDIARIES AND AFFILIATES AND THEIR SUPPLIERS AND LICENSORS (COLLECTIVELY, THE “LIDL PARTIES”) MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE LIDL GIFT CARDS, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING OR COURSE OF PERFORMANCE. THE LIDL PARTIES DO NOT REPRESENT OR WARRANT THAT YOUR LIDL GIFT CARDS WILL ALWAYS BE ACCESSIBLE OR ACCEPTED. IN THE EVENT THAT ANY LIDL PARTY IS FOUND LIABLE TO YOU, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR LIDL GIFT CARD. THE LIDL PARTIES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, REVENUE, GOODWILL OR USE) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THESE TERMS AND CONDITIONS, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ANY LIDL PARTY HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A LIDL GIFT CARD THROUGH ACCIDENT, MISUSE OR FRAUDULENT MEANS OR DEVICES BY YOU OR ANY THIRD PARTY, OR AS A RESULT OF ANY DELAY OR MISTAKE RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL. THE LAWS OF CERTAIN STATES OR OTHER JURISDICTION DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE RIGHTS IN ADDITION TO THOSE CONTAINED IN THESE TERMS AND CONDITIONS. IN SUCH JURISDICTION, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
